How to Set up a Pharmacy Business

The modern pharmacist entrepreneur has many avenues to build and grow their business. Here are five simple steps to set up a pharmacy business:

1.    Build a Business Plan

A sound business plan is the most crucial step in establishing a pharmacy business. It starts with a clear idea about the target consumer and the products or services they can offer. Next, this will determine the capital required for inventory and overhead costs like utilities, transport, space, staffing, manufacturing, and marketing. Finally, calculating selling prices to achieve a healthy profit margin needs creative business development and agile leadership.

2.    Secure Financing

To get a new venture successfully off the ground, business owners may have to secure funding from investors or raise capital with funding from a partner. When taking on a business loan, founders should be careful to  avoid loan scams , research the lender thoroughly and find the best solution for their financial circumstances.

3.    Arrange for Licenses

Pharmacies and medication-based businesses are generally heavily regulated. To set up a new business, pharmacists need to:

  • Register as a business entity in their state
  • Request for a federal  Employer Identification Number  (EIN)
  • Open a business bank account
  • State pharmacy license or permit
  • Controlled substance registration
  • National Council for Prescription Drug Programs  (NABP/NCPDP) number
  • Drug Enforcement Agency (DEA) number
  • National Provider Identifier (NPI) number

4.    Select a Location

The right location can significantly impact how much and how fast a new venture grows. Before investing in a new business, entrepreneurs should consult with experts to determine the  best states for business taxes in the U.S . Staying updated with current tax rules can make a big difference to the revenue margins of small, newly opened pharmacy businesses.

Founders who  detect the right location  for their pharmacy business can also broaden the scope for new partnerships with complementary businesses in the area and determine the hiring pool for new employees. In addition, real estate prices can be a deciding factor when buying or renting offices and storefronts for the venture.

5.    Create a Marketing Plan

From logo design to website building and PR, a sound marketing strategy is essential for a pharmacy business to scale. However, finding the right team to execute a marketing plan may be challenging, considering the requirements for specialized techniques like social media campaigns, paid ads, content marketing, and search engine optimization.

Offline marketing campaigns also require key leaders to network with other healthcare organizations in the community to build a healthy referral process.

Entrepreneurs setting up pharmacy businesses are poised to experience tremendous growth if they can set up and scale their ventures successfully. Northern Maine Medical Center to partner with St. John Valley Pharmacy

FORT KENT, Maine – Northern Maine Medical Center is pleased to announce its plan to partner with St. John Valley Pharmacy, a well-regarded community pharmacy located on Market Street in Fort Kent. This marks a significant milestone in NMMC’s and SJVRx’s commitment to expanding access to comprehensive healthcare services, by uniting long-standing, local healthcare providers.

This partnership, anticipated by October 1, will enhance the continuum of care for patients in Northern Maine by integrating St. John Valley Pharmacy’s services with NMMC’s existing healthcare network. This move aligns with NMMC’s and SJVRx’s mission to provide high-quality, patient-centered care while addressing the growing needs of the community. 

Officials at NMMC and SJVRx emphasize that no services will change at the pharmacy, and there will be no impact on jobs other than SJVRx employees becoming part of NMMC. Charles Ouellette, owner of St. John Valley Pharmacy, will remain in charge of operations. As part of the plan, NMMC will move its Fort Kent outpatient pharmacy operation to SJVRx while inpatient pharmacy operations at NMMC remain unchanged.   

 “Our partnership with St. John Valley Pharmacy will support the continuation of a locally owned pharmacy that serves the entire community and beyond. Northern Maine Medical Center is an independent health system and Saint John Valley Pharmacy always has been and will continue to operate as it stands today, but will gain the advantages of coming together,” said Jeff Zewe, CEO of Northern Maine Medical Center. “We are honored to embrace the responsibility of continuing the tradition of excellent access, quality and community-based services. Pharmacy has evolved into such a specialty; we are privileged to work with Charlie and the St. John Valley Pharmacy team, leveraging their expertise as we move forward.” 

SJVRx has been independently serving the region for 20 years, offering the highest quality service, holding Accreditation with the Healthcare Quality Association on Accreditation. Customers of St. John Valley Pharmacy will see no changes, including service and insurance coverage. Pharmacy services to several long-term care facility clients will remain unchanged as will the hospital’s operations at its Madawaska pharmacy.  

“My staff and I are excited about this new chapter and look forward to continuing to serve our community with the added support and resources that Northern Maine Medical Center provides,” said Ouellette. “Bringing together services under one roof creates synergy, efficiency and eliminates duplication of services.” The acquisition helps meet the challenges of the pharmacy arena, where national drug prices continue to rise, and recruitment and retention of pharmacists and pharmacy techs is increasingly difficult. Leadership from both facilities agree, “Together, we are better.”

Delray pharmacy owner says he was 'duped' into defrauding Medicare out of $1 million

WEST PALM BEACH — A Delray Beach man who said he was "duped" into helping his business partners defraud Medicare will spend a year in federal prison for the crime.

Jamie Michael Larkin, 37, pleaded guilty in February to conspiring to commit health care fraud, a felony for which he faced up to 10 years in prison. Federal prosecutors recommended a lighter sentence during a recent hearing in West Palm Beach, pointing to the assistance they said Larkin provided investigators.

Larkin said Patrick O'Brien and Omar Solari — two men who had burned their relationships with insurance companies in previous audits — approached him in 2021 with an intriguing business opportunity: Invest $115,000 in a Georgia pharmacy called Rite Care and become its owner, splitting the profits equally among the three men.

The pair promised to manage all facets of the operation while upholding Larkin as its sole owner to keep their interests in the pharmacy hidden, lest they be audited again. They also promised Larkin that he could one day sell the pharmacy and keep the proceeds for himself.

Larkin agreed, signing off on business documents from his Delray Beach home 650 miles south of the pharmacy. Prosecutors said his signature paved the way for a yearlong scam involving unscrupulous telemedicine companies and thousands of unwitting beneficiaries.

O'Brien and Solari paid telemarketers to cold-call elderly and disabled Medicare beneficiaries and encourage them to accept prescriptions for topical creams, at no cost to the beneficiaries. According to court records, the men then paid kickbacks to telemedicine companies for bogus consultations with the beneficiaries, creating thousands of falsified prescriptions.

Investigators said the duo continued to submit fraudulent claims for months' worth of refills even after beneficiaries complained that they didn't want the medication, did not use it and had too much of it. Prosecutors said they defrauded Medicare out of $997,911 in the span of a year.

Though Larkin was promised 33% of the profits, he said he was repaid only $70,000 and "actually lost money" during the conspiracy.

Defense attorney Tama Kudman blamed O'Brien and Solari for misrepresenting the investment opportunity they pitched Larkin. He didn't know his business partners were paying kickbacks or submitting bills for unnecessary medical services, she said, nor that they had a legal obligation to disclose their interests in the pharmacy.

She added that Larkin took full responsibility for his role in the crime and cooperated with law enforcement when approached about the scheme. Kudman told U.S. District Judge Aileen Cannon that Larkin was a changed man. She described him as a successful and responsible business owner, who now chooses his friends more wisely and scrutinizes business opportunities more carefully.

"In short, he has grown up," Kudman said.

She asked Cannon to sentence him to home confinement, contending that the near million-dollar restitution he owes the government is punishment enough.

Assistant U.S. Attorney Timothy Abraham said that while Larkin's role was minor compared to that of his co-conspirators, it warranted more than a non-prison penalty. He pointed to Larkin's criminal history, which included selling black-market steroids in Palm Beach County and laundering more than $2 million between 2019 and 2021.

Cannon agreed. She sentenced Larkin on July 23 to one year in prison, followed by two years of supervised release. The judge barred Larkin from owning any healthcare business during the two-year term. His co-conspirators have not yet been sentenced.

A Checklist for Compounded Semaglutide or Tirzepatide

Consider this: If you're taking your child to the beach, how do you protect them from drowning ? You don't tell them, "Don't go into the ocean." You teach them how to swim; you give them floaties; and you accompany them in the water and go in only when a lifeguard is present. In other words, you give them all the tools to protect themselves because you know they will go into the ocean anyway.

Patients are diving into the ocean. Patients with obesity, who know that a treatment for their disease exists but is inaccessible, are diving into the ocean. Unfortunately, they are diving in without floaties or a lifeguard, and well-meaning bystanders are simply telling them to not go. 

Compounded peptides are an ocean of alternative therapies. Even though compounding pharmacists need specialized training, facilities and equipment need to be properly certified, and final dosage forms need extensive testing, pharmacies are not equal when it comes to sterile compounding. Regulatory agencies like the US Food and Drug Administration (FDA) have expressed caution around compounded semaglutide . Professional societies like the Obesity Medicine Association (OMA) advise against compounded peptides because they lack clinical trials that prove their safety and efficacy. Ask any individual doctor and you are likely to receive a range of opinions. 

As an endocrinologist specializing in obesity, I practice evidence-based medicine as much as possible. However, I also recognize how today's dysfunctional medical system compels patients to dive into that ocean in search of an alternative solution. 

Doctors can't be lifeguards, but we can at least empower patients who want to decide for themselves whether the risk of compounded peptides is worth it. 

With the help of pharmacists, compounding pharmacists, researchers, and clinicians, here is a checklist for patients who seek compounded semaglutide or tirzepatide : 

  • Check the state licensing board website to see if there have been any complaints or disciplinary actions made against the pharmacy facility. These government-maintained websites vary in searchability and user-friendliness, but you are specifically looking for whether the FDA ever issued a 483 form .
  • Ask for the pharmacy's state board inspection report. There should be at least one of these reports, issued at the pharmacy's founding, and there may be more depending on individual state regulations on frequencies of inspections.
  • Ask if the compounding pharmacy is accredited by the Pharmacy Compounding Accreditation Board (PCAB) . Accreditation is an extra optional step that some compounding pharmacies take to be legitimized by a third party.
  • Ask if the pharmacy follows Current Good Manufacturing Practice (CGMP) . CGMP is not required of 503a pharmacies, which are pharmacies that provide semaglutide or tirzepatide directly to patients, but following CGMP means an extra level of quality assurance. The bare minimum for anyone doing sterile compounding in the United States is to meet the standards found in the US Pharmacopeia, chapter <797>, Sterile Compounding .
  • Ask your compounding pharmacy where they source the medication's active pharmaceutical ingredient (API).
  • Find out if this supplier is registered with the FDA by searching here or here .
  • Confirm that semaglutide base, not semaglutide salt, is used in the compounding process.
  • Request a certificate of analysis (COA) of the active pharmaceutical ingredient, which should be semaglutide base. This shows you whether the medication has impurities or byproducts due to its manufacturing process.
  • Ask if they have third-party confirmation of potency, stability, and sterility testing of the final product.

In generating this guidance, I'm not endorsing compounded peptides, and in fact, recognize that there is nothing keeping small-time compounding pharmacies from skirting some of these quality measures, falsifying records, and flying under the radar. However, I hope this checklist serves as a starting point for education and risk mitigation. If a compounder is unwilling or unable to answer these questions, consider it a red flag and look elsewhere. 

In an ideal world, the state regulators or the FDA would proactively supervise instead of reactively monitor; trusted compounding pharmacies would be systematically activated to ease medication shortages; and patients with obesity would have access to safe and efficacious treatments for their disease. Until then, we as providers can acknowledge the disappointments of our healthcare system while still developing realistic and individualized solutions that prioritize patient care and safety.

The Biden administration on Thursday unveiled the results of landmark drug price negotiations between Medicare and pharmaceutical companies, allowing President Biden and Vice President Kamala Harris to cast themselves as confronting the drug industry on behalf of older Americans at a critical moment in the presidential campaign.

The negotiated prices, which take effect in 2026, are expected to save billions of dollars for Medicare, which is funded by taxpayers. But they will lead to direct out-of-pocket savings for only a subset of the millions of older Americans who take the drugs subject to negotiations.

Other provisions of the law that created the drug negotiation program, such as capping patients’ expenses for insulin and their yearly out-of-pocket drug costs, will do more to save older Americans money at the pharmacy counter.

The 10 drugs subject to negotiations include widely used blood thinners and arthritis medications. Had the new prices been in effect last year, administration officials said, Medicare would have saved $6 billion, which would have reduced its spending on those drugs by 22 percent.

“This is a fight all of us have been fighting for a long time: taking on Big Pharma,” Mr. Biden said at an event in Maryland celebrating the announcement, where he and Ms. Harris had their first joint public appearance since she took over the Democratic presidential ticket.

The negotiations, a longtime aspiration of Democrats, are the first that the federal government has directly conducted with drugmakers on behalf of Medicare beneficiaries. Mr. Biden on Thursday recalled working on legislation as a senator in the 1970s that would have allowed Medicare to negotiate prices directly.
