A land lease proposal letter is a document that is created in the form of a letter which is used by the landlord to lease a plot of land to another individual for a specific period of time in return for a rent. The letter can be written either on behalf of the landlord or the tenant, where the basic terms and conditions of the lease are suggested. After getting a positive reply to the proposal letter, a formal written agreement can be made regarding the lease of the land. The main points to be included in the letter are the names and address of the respective parties, location and other details of the plot, rent and term of lease.

September’s Grazier’s Focus is about working with neighboring crop farmers to graze cover crops and crop residue. As a warm up, here’s something you might need – a letter of introduction or a resume that helps them get to know you .

There is no magic recipe that will make a prospective landlord say, “Yes! I’ll lease my land to you!” But knowing what a landlord is looking for and how to show him/her that you’ve got what they want can improve your chances. These tips come to us from Iowa’s Beginning Farmer Center , and though they are geared to a beginning farmer, even a seasoned pro can use them.

Step 1:  Understand What a Landlord Wants

The table below show what landlords told researchers they look for most: a “good farmer.” They defined a good farmer as someone using good practices, who controls weeds, completes tasks in a timely way, has good equipment, and a good reputation. A good farmer takes care of the land with practices that conserve soil and water. In fact, conservation practices are so important, that they also show up separately as a reason for choosing a renter. Not surprisingly, “Honesty” is also very high on the list. Landlords said they wanted someone they could trust, who communicated well, respected their wishes, and who was easy to work with. Of course, since this is a business transaction, financial stability is important to landlords. They want to know that the rent will be paid.

What A Farm Landlord Wants

Step 2:  Show Landlords You’ve Got What They Want

This is just like applying for a job. You can use a letter or a resume to describe the things you have to offer. Either way, writing these things down helps you get your thoughts together, organize them, and then present them in a professional way. They can be especially helpful if you feel a little nervous when it comes to telling folks about all your finer qualities. When they’re on paper, it’s almost as if someone else is blowing your horn instead of just you. As you write, keep in mind the list of the things that your landlord is looking for. You can even use some of the words and phrases from the paragraph above to describe yourself. Here’s an example:

“I am a conservation-minded farmer focused on protecting and improving soil and water quality, while providing a healthy product and a financially stable home for my family. I pride myself on being honest, and work hard to have good relationships and communication with the people I work for and with.”

A farmer/rancher resume or letter is geared toward your audience: the landlord you’re hoping to lease from. Here are some suggestions for doing that:

Contact Information

Your name, address, phone number and email address should be the very first thing the reader sees at the top of the resume or the top of the letter.

Management Objectives/Mission

This is a statement in a couple of sentences that tells what you’re trying to accomplish. If you’ve been doing some business planning, you could include your mission statement here. I think Grass Whisperer Troy Bishopp has a great statement:

“We strive for a stress-free life. We want our topsoil covered by diverse pastures harvested by animals, thus recycling solar energy and activating biological life to provide a sustainable profit. We want to regenerate our community with local food, create a savannah for wildlife, and create a place for the next generation to thrive.”

Education  

Do you have formal education in agriculture? Include that here. If your education in agriculture comes from personal experience, describe that instead. Or if you’ve got some of both, share that.

“I am a lifelong learner who has studied agriculture from (the back of a horse/ the seat of a 4 wheeler or tractor) for the last __ years. In addition to learning from the land, and the animals I manage, I participate in workshops and read journals and books so I can keep up with advances and improve my management skills.” “I learned about grazing management following in my parents’ footsteps, building fence, moving cows, bucking bales, and hauling irrigation pipe.  I’ve added to this background with a degree in _______ from _________, and by studying with extension, NRCS and conservation district staff, to ensure that my management is the best it can be.”

Experience:

Do you already manage acreage? Share that. Add information about your successes such as improvements in yields or stocking per acre. What you’re trying to do here is share information that will help your reader see you as good at your job, or someone with potential to be good at farming.

Advanced Training, Certifications, Licenses

If you’ve attended special workshops or training, and/or have certifications and licenses list them here. Did you attend a stockmanship workshop? Do you have an applicator’s license for herbicides, and my favorite, have you taught your livestock to eat weeds?

Risk Management Strategies

Remember, the landlord wants to know that you’ll be able to pay the bills. So describing what you’re doing to minimize losses is a good thing. Here’s an example:

“I am actively involved in a University of Missouri extension marketing club which allows me to hone my marketing skills. I subscribe to DTN AgDayta which allows for up-to-date price quotes and marketing recommendations.”

If you have insurance already, share that information. If not, you can skip this section or note that you’ll be acquiring it.

Organizations:

Being a member of an organization can demonstrate your commitment to your community and your vocation. So tell your prospective landlord about them.

You can mail the letter, or you can set up an appointment and deliver it in person.

The typical phrase here is “Available upon request.”  You can have the list with you when you visit the farmer, or be ready to send them if asked.

Polish it Until It Shines

Remember, this is your best foot forward. It should be grammatically correct and everything needs to be spelled correctly. My rule of thumb when I’m done with something like this is that I can look at it and say, “Hey! This looks like something a grown up did.” Not sure you’ve got it right? Take the time to have it reviewed by others. Family members are a start, but even better might be folks in Extension, or at the NRCS or Conservation District Offices.

What is a land lease agreement?

A land lease agreement is made to allow a person who is the owner of a piece of land to rent the land to another person or a company. This might be for personal use or business use, depending upon the kind of property that is being leased out. The most common reasons to enter into this kind of arrangement are:

  • Farming or agriculture
  • Land development
  • Commercial reasons like advertising near the freeway or billboard use

There are various kinds of land lease agreements that you might need to enter into as well. These different types of land leases can be written differently, so you need to be sure that you are aware of the various kinds and what they are used for.

  • Agricultural Land Leases. These leases are done to allow for a property to be farmed or for a crop to be installed on the property. This might be an orchard or some other long-term commitment that takes a lot of time to establish. These kinds of leases can also govern the use of properties for livestock like cows and goats or sheep. These leases tend to be for very long spans of years due to the nature of the crop growing or animal husbandry process.
  • Commercial Land Leases. The most common reason to create this kind of land lease agreement is to allow someone to install a billboard or some kind of sign or telecommunications tower on a property that you own. This might also be the right kind of agreement for the creation of a hotel complex or a food chain restaurant on your property.
  • Residential Land Leases .   These leases are done to allow someone to create a trailer park or to put a small cabin in the woods. This is a much less commonly used form of the land lease agreement, but it can have its place from time to time.

How to write a land lease agreement

These agreements can be quite simple or very complex, depending upon the needs of both parties that are involved in the agreement. You will need to have some minimum detail included in the land lease agreement that you have created so that you can be sure that it will be legally valid for your use if there is any need to revisit the document to further define the lease or to handle conflict about the way that it is being operated.

  • Who is the party that is leasing the land? This will be a business or a person, and either of these entities need to be indicated with full legal names and addresses as well as contact information. You should be sure that you are very clear about the details of this part of the agreement, so there is no confusion about who the document is referring to.
  • What is the amount that the tenant will need to pay per month? You can also indicate if the person will be paying for this amount in quarterly payments, monthly, or annually.
  • Where the land is located also needs to be indicated, and the landlord needs to indicate if there is only a portion of the land that is being used by the tenant who is renting it. This might also include a description of the way that the property is laid out and what access it has.
  • When will the lease end? This is important so that there is no confusion about the endpoint of the lease agreement. This lease might be renewed automatically, but these details also need to be agreed upon in the lease document that you are creating.
  • Can the landlord keep improvements that were made to the land by the tenant once the tenant vacates? Will the landlord have to reimburse the tenant if so?
  • What are the permitted uses for the land?
  • How will rent be paid? This might be a lump sum, an automatically deducted payment, or any other arrangement that is legal and works for both you and the person who is leasing the property.

Some other things that you might want to consider clarifying in your land lease agreement are:

  • Access. Access to the land can be defined in any way that suits both tenant and landlord. The landlord is usually still allowed access to the land, but this is not always the case.
  • Amendment. This is the clause that indicates what has to be done to change the agreement or to alter it in any way. This might also be the clause that talks about early termination or the reasons that the contract might be considered null and void.
  • Choice of Law. This is the state or county that will provide the legal information that is used to determine legal processes surrounding the land lease agreement and its execution.
  • Disputes. How disputes between the owner of the property and the tenant are handled should always be discussed in this section of the document. This can have a major impact on the way in which these inevitable conflicts happen, and you should be sure that you include this information in your document.
  • Duration. If you want to stipulate specific limitations on the use of the land in question based on the dates of certain crops or if you want to split the use of the land with the tenant for some reason, this is the section of the document where you indicate duration and stipulations about a time where the property is under the control of the tenant.
  • Facilities. There might be pre-existing buildings on your property, and you may or may not want to allow your tenants to use them.
  • Security Requirements. If you require that there is a gate that is kept closed or that fencing is kept up to keep the public out, this needs to be included in your lease agreement. This kind of information has to be disclosed to the tenant upfront so that they can maintain this requirement from the start of their time working on the property.
  • Government Regulations. This is the section where you indicate if there are any government requirements that need to be followed to be sure that your property use and the lease can be maintained correctly. This is not common for anything other than farming or certain production industries but you will need to be sure that your tenant is aware of these limitations so that there is no issue with federal law.

What are the pros and cons of leased land?

There are pros and cons to consider with any lease of your land. You will need to keep all of these things in mind when you decide to lease the land out to a tenant. Just like when you are leasing out a building or a house to someone, there are reasons that you might be glad that you have done so and things that can cause you regret. Be sure that you think about these considerations before you have signed a ten-year lease that you wish you had not signed.

Pros – The pros of leasing out land are that it will make money for you while you are not using it and that you will not have to take care of it during the term of the lease. This means that you will be able to just bring in rent money without much effort on your part and without having to think too hard about the considerations to do with care for the property or its cost to you as the owner.

One of the other pros to this arrangement is that some kinds of property cannot really be left undeveloped or unused for too long, or they will lose value. If you are not in a position to make the most of a property, a good lease can make sure that your property is being maintained and that its value is not diminished by just sitting empty and unused.

Cons – There are some downsides to this arrangement that you need to consider as well. The first and most obvious of these is that sometimes you might run into conflict with your tenant. This is why you need to have a good quality land lease agreement in place so that these conflicts do not escalate into legal matters.

The other downside that many people do not think about is that they will not have as much say over the use of the land that they own as they might think. You might not be able to stop your tenant from doing things that you would not prefer for them to do, and you might not have thought to prevent these actions through the language of your land lease agreement. You will also have to sometimes check up on your tenant and force them to comply with the agreement that they signed.

The biggest downside of this agreement is that if the tenant makes improvements to your land and you break the lease, you will almost always have to compensate them for these changes. This can be very expensive, and you might not want to be put in this position, especially if the improvements are of no benefit to you specifically.

Land leases can be really ideal for many reasons, but they come with many complexities that you might not immediately think of when you plan to lease your property to someone else. This is very much a look before you leap kind of agreement, and the better your land lease agreement, the easier your relationship will be with your tenant.

If you are worried about the way that your land lease agreement is laid out, be sure that you consider taking it to have a lawyer look at it for you. The better your coverage for all kinds of possible problems in the document, the better your land lease agreement will work for your needs. Be sure that you are sure that you want to lease your land to someone before you sign the document, and also be sure that you have thought about the details of this lease carefully before you decide to commit to it.

A Land Lease Agreement is a document used by the owner of a vacant piece of property, known as the landlord, and an individual or entity who wants to occupy the land and develop or improve it, known as the tenant . The lease is for the right to occupy real estate comprised of only dirt and soil, so the land can be used by the tenant for multiple uses ranging from agricultural to residential or commercial purposes . Agricultural land leases can include the use of land as a farm for crops, an orchard for trees, a ranch for hunting wild game and forest animals on the premises, or as a pasture for grazing animals like cattle, goats, and sheep. Commercial land leases can vary from the right to install a billboard, build a telecommunications tower to be used for wireless cell phone reception, open a chain restaurant, or develop a large multi-story hotel complex. Residential land leases can include a spot to park a trailer in a trailer park or the right to construct a small cabin in the woods.

Individuals who purchase, inherit, or otherwise own undeveloped land in either urban or rural settings may benefit from a Land Lease if they want to generate some passive income without the hassle of personally investing the capital, labor, or time needed to build structures and start an independent venture. In rural communities, this sort of tenant farming is common for agricultural or hunting purposes. In these situations, a tenant may have tools or livestock and enough funds to pay for the right to use land, but lack the capital to purchase their own parcel of land outright. In addition to raising livestock or crops, landowners with large properties in the countryside may profit from leasing their property to a hunter or hunting association during hunting season. In addition to earning a seasonal income, a Land Lease to hunt on uninhabited land may prevent crop damage and disease in livestock by managing wildlife in the area. In urban settings, a Land Lease is often used by large chain stores that would like to take advantage of a prime location without having to pay large sums of money for the underlying real estate. By using a Land Lease, the tenant has access to land that they would not otherwise have had access to and the landlord generates steady income with the potential of inheriting any structures or improvements built on the land when the lease ends .

This Agreement is specifically for leasing land that is undeveloped and not for the purpose of renting structures on the land. A Farm Lease Agreement can be used to lease a developed farm that has crops or livestock, a Commercial Lease Agreement can be used to lease a developed commercial property, and a Residential Lease Agreement can be used to lease a developed residential property.

How to use this document

This document includes all of the information necessary to create a thorough and comprehensive Land Lease Agreement. This Agreement can be created by either the landlord or the tenant but its terms must be agreed to and signed by both parties. The document includes various options to tailor the Agreement to meet the parties' needs. The Agreement allows the Parties to specify the following important details that will guide their landlord/tenant relationship :

  • Name and contact information for both Parties, including the landlord, the tenant, and anyone who the landlord is allowing to managing the property, such as an assistant or property manager
  • Description of the type of property being leased and its location
  • Length of the lease , specific start and end dates, and whether and how the lease term may be renewed after the termination of the initial lease term
  • Amount of money that the tenant will pay for a security deposit, rent payments, and late fees
  • Responsibilities that must be fulfilled by each party under this Agreement, such as maintaining the property, paying for utilities, maintaining liability and property insurance, paying taxes, and using the property in an acceptable manner
  • Description of the tenant's rights to develop the land and potentially use their leasehold interest as a security to get a loan to pay for the development

After inputting the required information, the Agreement is printed out and signed by both Parties, and then kept on file by both Parties for the duration of the Agreement as well as for a reasonable period of time thereafter.

It is a contract that addresses the rights and responsibilities of the lessee and lessor. The landlord will usually require periodic payment and, in some cases, royalties in addition to rent payments. This and other terms of the transaction are laid out in the land (farm) lease agreement.

Renting land to another person or company is typically associated with certain terms and conditions of use or utilization. A land lease agreement allows the capturing of the expectations from each party (lessor and lessee) regarding the arrangement/transaction. This way, the agreement acts as the “constitution” of the arrangement. These agreements are thus used by landowners who intend to rent out their farm to another person or company.

The agreement communicates the obligations and permissions accorded to the lessee and other terms, such as the applicable compensation/rent for occupying and using the land. Therefore, a landowner can use the agreement to lease their property for hunting, grazing, building hotels, constructing a residential house, building a telecommunication tower, etc.

A farm lease agreement is legally binding and will typically be executed in accordance with the laws of the specific state where the land is located. It is advisable to have the document in writing as it is more enforceable than a verbal agreement.

When and Why Do You Need It

Land lease agreements are common in both rural and urban settings. A land (farm) lease agreement provides many advantages to both parties involved in leasing a piece of land. It acts as the “constitution” of the arrangement. You, as the landowner, can obtain significant financial benefits from leasing your land to another person or company.

The rent is relatively high compared to what you would normally get if you decided to sell your property. This way, the agreement allows you to start earning some passive income without necessarily injecting resources into your farm or selling the property. Common uses of the land lease through farm lease agreements are agricultural, commercial, and residential uses.

Additionally, royalties are often paid instead of or in addition to rent as compensation from the lessee to the lessor. Royalties are a percentage of any revenue resulting from a contract with an independent third party (e.g., a client consultant, consultant, business entity, or any other business with which the lessee is associated) developed on the leased land. You, as the landlord, benefit because you no longer have to waste time and money worrying about upkeep, maintenance, and the property’s decreasing value.

This reduces costs associated with the property and mortgage payments. The document also ensures the responsibilities of each party are well defined – for example, property tax duties, maintenance, land use permits application, rental rates, etc. Disputes can also be prevented through the farm lease agreement, should they occur. What Should be Included?

These agreements will vary from one leasing arrangement to another. However, there are some essential components that should be included in a lease agreement for land or farm.

These include:

Contracting parties and date

The details of the contracting parties (i.e., lessor and lessee) of the agreement should be clearly stated in the document so that it becomes easier to identify both parties. In this case, you may consider including the contact details of both parties. However, if one party is a business, include the names and information about that business in this section as well. Also, the farm lease agreement should be dated.

Property description 

It is important to include property descriptions in the agreement. The description should be accurate enough to enable both parties to identify the land or farm being used for the stated purpose. Details such as the size of the plot, plot number, location, etc., can be provided in the description.

The landowner or lessor should take a clear picture or shoot a video of the property from different angles so as to be able to depict it accurately in the document. Also, the USDA Farm Service Agency (FSA) maps can be attached to the agreement if you are participating in USDA form programs. This way, disagreements over whether the property described is actually what was leased by both parties can be avoided.

Rent amount

The rent amount is the major determining factor in the lease agreement. The rent amount should reflect the actual market value of the property. Therefore, a professional valuation of the property can be conducted to determine an accurate rent amount. The agreed-on figure should be indicated in the farm lease agreement.

Duration of lease

The duration of the lease (lease term) is the period of time during which the lessee will be able to use and occupy the property. It usually ranges from one year to several decades, depending on the arrangement between the landowner and the lessee. Therefore, the agreement should be worded clearly in accordance with this period so as not to cause any legal disputes after the expiration date.

General terms of the lease

It is important to state the general terms of the lease agreement in order to serve as a reference in the event of a dispute relating to any of the terms and conditions stipulated. The terms cover a wide range of aspects ranging from the term of the lease, permitted land uses, rights retained by the landowner, implied exclusive possession of the property of the tenant, contractual procedures for inspection, repairs to issuing notice, etc.

Some of the lease terms included in agreement are:

  • Access: The agreement should include the terms and conditions that govern the lessor’s access to the property. For example, when can the lessor enters the property, and which access areas should they use?
  • Amendment: The document should indicate the appropriate procedure for amending it. The reasons that justify the amendment should be limited to certain situations in order to avoid misuse. Most land-lease agreements warrant the amendment to be in writing.     
  • Choice of law: The documents should stipulate under which law the agreement will be enforced. The law in question should be the same jurisdiction as the land.
  • Disputes: It is important to include the process of dispute resolution in the agreement. The affected party can initiate grievances and arbitration processes before resorting to legal action.
  • Facilities: The agreement should include the details of the facilities provided by the lessor to the lessee at no additional cost. The facilities may be parking space, playfield, etc.
  • Gate requirements: The lessor can issue any gate instructions necessary. For example, when they should be fully closed, which gates not to leave open, and reasons for such requirements. 
  • Government regulations: The lessor should state the government regulations governing the property and what measures must be implemented to comply with these regulations. The farm lease agreement must also indicate the party responsible for observing such regulations.
  • Improvements: The agreement should state any improvements and alterations on the land that the lessee can make on the property. The document must also state if the lessee has to seek permission from the lessor.
  • Insurance: The lessor should indicate which party is responsible for insuring the property, what insurance policies must be in place, and who covers any claims resulting from accidents, injuries, or maintenance work on the land.
  • Liability: The agreement should clarify whether the lessee requires liability insurance. It must also state if the lessor will be exempt from certain liabilities and which liabilities those will be.
  • Maintenance: The agreement should state the responsibilities of both parties in case of any maintenance work on the property. In addition, the lessee’s duties and responsibilities toward maintaining the value of the land must also be clarified.  
  • Mineral or subsurface rights: The lease agreement should include any mineral or subsurface rights of the property the lessee is awarded. The parties should also state the appropriate method for addressing such disputes in instances where such rights are at play.
  • Mortgages: The agreement must state whether the mortgage is permitted on the leased property. The mortgage details include the purpose and duration of borrowing.
  • Permits: The lessee and lessor must agree on who is responsible for acquiring any permits/approvals and what happens in the event of failure to acquire them.
  • Subletting: The agreement should indicate whether the lessee will be able to sublease or lease out the property. In addition, the appropriate procedure for subletting should be provided.
  • Utilities: The agreement should mention whether the lessee will be responsible for buying and maintaining any required utilities, including power, water, sewage, etc.
  • Severability: The lease agreement should clarify that in the event of any conflict between individual provisions of the farm lease agreement, the entire agreement will not be affected but only the mentioned conflicting provision.
  • Surrender: The document should have a section stating under what conditions the lessee will be required to surrender the land at the end of the lease term. 
  • Taxes: The agreement should state whether taxes must be paid and who is responsible for paying them. Taxes can be local, state, or federal taxes. The agreement should also contain provisions on when payment of any additional taxes is due and what happens in case of late payment.
  • Use of motorized vehicles: The farm lease agreement can also stipulate the terms under which the lessor can use motorized vehicles on the property. Examples of motor vehicles that can be regulated are all-terrain vehicles, four-wheelers, etc.

The lease agreement should stipulate that the land will be used for certain activities, including farming, stock rearing, and timber cutting, among other uses, in consideration of no rent or a lower amount. The document must also show any applicable conservation plans such as soil conservation practices, pesticide and fertilizer application limitations and limitations in terms of changes to the property and its resources such as trees.

Security deposit

A section that addresses matters regarding the security deposit should be provided. A security deposit is any money paid by the lessee to the lessor at an initial stage to guarantee that the lease agreement will be upheld. The lessor can determine the security deposit amount which should be returned to the lessee if all lease contract terms are met. However, in instances where there is a breach of any term of the agreement, both parties must agree on how to use these funds.

Payment and due dates

The agreement must state the amount and procedures of any rent, including payment dates, procedures, and any penalties for late payments. Rental rates can be determined based on acreage, land size, land use, the productivity of parcels, or any other arrangement.

Termination

The document must clearly state how termination will work, whether it is automatic by a certain period, will involve any notice periods, or require any reason to initiate termination proceedings. Therefore, the agreement should clearly state any notice requirements applicable to both parties and the process to be followed in case of termination and what would lead to this action.

Signatures 

Lastly, a section that stipulates all the signatures that are required for the document to be authenticated and legally enforceable must be provided. Typically the lessor and the lessee should sign the lease agreement.

Types of Land Lease Agreements

Leases are contractual documents that serve as proof of the parties involved in an agreement to transfer the rights and responsibilities over a piece of land. Such agreements do not transfer ownership rights but instead only involve certain rights over the property, including building houses or using the land for farming. Therefore, two types of these lease agreements are commonly used by landowners.

They include:

Subordinated land lease agreement

This type of agreement is used to grant the lessee the right to use the property title to secure a leasehold mortgage or funds to make land improvements. With this provision, the landowner can ask for higher rental rates due to the risk involved since should the lessee default on the mortgage or loan, the landowner stands to lose their property through foreclosure. 

Unsubordinated land lease agreement

This agreement prohibits the use of the title to the property for leasehold mortgage. As a result, this type of agreement is less risky for landowners and beneficial in that should the lessee default on their construction loan, land improvements are typically transferred to the landowner, and the land’s market value goes up. Consequently, the landowner is expected to charge a lower rental fee as he or she bears little to no risk.

Consequences of Not Using a Lease Agreement

Not having this agreement in place can result in misunderstandings between the lessor and the lessee since there is no reference tool to determine what was agreed on between the parties. More so for third parties who were not present when the parties agreed on leasing the land. This can result in the landowner assuming unwarranted liabilities resulting from the tenant’s actions or agreements with third parties.

Without a farm lease agreement, there won’t be a defined framework for resolving disputes in the future or in a court of law. Courts are known to value written agreements over verbal or handshake agreements. In addition, a lease agreement avoids interpretation issues hence helping judges make decisions.

Additionally, without an agreement in place, it becomes difficult for the landowner to have a reliable income source, with rental rates for farms being lower than that for houses. This will lead to greater chances of experiencing financial setbacks and bankruptcy in the absence of a steady income source.

Without a land lease agreement, there is no structure or system on what rights and responsibilities are to be shared, amount of rent to be paid, due dates, consequences of breach of contract, etc. As a result, it becomes significantly difficult to hold parties accountable for such obligations should they not be done at all or in a timely manner.

The value of a land lease is the price a willing buyer would pay to acquire the lease on the property. To ascertain this value, professional evaluators are hired to determine the projected lease rate, escalation schedule, and terminal value before discount. The discount rate will typically depend on the risk profile of the projected cash stream (the project of the lessee). Based on these factors, the tenant thus pays equivalent rent or other compensation to use that property for some period of time.

Land lease agreements help the lessor and lessee avoid real estate taxes that would be incurred should the parcel have been sold. Land leasing also helps the lessor earn income from their land without giving up their ownership. A tenant benefits from the agreement because it is more affordable as they do not have to raise high start-up capital, as would have been the case if they were to purchase the land. Additionally, the lessee can gain access to prime lands that would nearly be impossible to purchase upfront through land leasing.

Several factors will influence the rental rate of a land lease. These factors include area demand (competition), potential returns on investment, land quality or yield potential, slope and erosion potential of the parcel, available facilities and utilities, and previous history between the lessor and lessee.
