सेंसरशिप का तात्पर्य:

• सेंसरशिप एक ऐसा माध्यम है जो इस बात की निष्पक्ष जाँच करता है कि सार्वजनिक डोमेन में क्या प्रसारित किया जाना चाहिये। साथ ही यह जानकारी अथवा डेटा शांति, सद्भाव एवं सामाजिक व्यवस्था बनाए रखने के लिये कुछ सामान्य रूप से स्वीकार्य मानकों को कैसे पूरा करता है?
• भारतीय कानून में 'सेंसरशिप' शब्द ने अक्सर आम लोगों, राजनेताओं, विचारकों, संगठनों और विभिन्न अन्य समूहों के बीच ज़ोरदार बहस को जन्म दिया है।
• हालाँकि, सेंसरशिप के अर्थ, संचालन के आधार एवं व्याख्या के कई ऐसे आयाम हैं जो इस आमतौर पर ग्रहण की गई परिभाषा से परे है और इसके आवेदन और अवलोकन की प्रक्रिया में व्यक्तिनिष्ठ है। इससे सेंसरशिप कानून का दुरुपयोग होने का खतरा बना रहता है।
• भारत के संदर्भ में सेंसरशिप कानून सार्वजनिक डोमेन में आने वाले प्रत्येक विषय को अपने प्रभावक्षेत्र में लेते हैं – विज्ञापन, थिएटर, फिल्में, श्रृंखला, संगीत, भाषण, रिपोर्ट, बहस, पत्रिकाएंँ, समाचार पत्र, नाटक, कला, नृत्य, साहित्य, लिखित, वृत्तचित्र या मौखिक कार्यों के कोई भी रूप।
• इस प्रकार ऐसे कई उदाहरण हैं जब भाषणों और सार्वजनिक अभिव्यक्ति के अन्य रूपों को अपमानजनक, अभद्र, अनैतिक एवं सार्वजनिक व्यवस्था के खिलाफ या धार्मिक भावनाओं को आहत करने के कारण सार्वजनिक डोमेन से हटा दिया गया है। वस्तुतः ये ऐसे पैरामीटर जिनकी कोई विशिष्ट परिभाषा या उचित रूपरेखा तय नहीं है।
• ऐसे उदाहरण उनकी महत्वाकांक्षा, दायरे और संख्या में बढ़ रहे हैं एवं भाषण और अभिव्यक्ति की स्वतंत्रता के लिये एक बड़े खतरे के रूप में देखे जाते हैं।

भारत में कार्य प्रणाली:

• सेंसरशिप प्रक्रिया संबंधित प्राधिकारी या नामित निकाय द्वारा की जाती है।
• सेंसरशिप का प्रयोग भारत में प्रत्यक्ष और अप्रत्यक्ष रूप से विभिन्न कानूनों और प्राधिकरणों के माध्यम से यथा भारतीय दंड संहिता , दंड प्रक्रिया संहिता , केंद्रीय फिल्म प्रमाणन बोर्ड, भारतीय प्रेस परिषद, सिनेमैटोग्राफ अधिनियम, 1952, केबल टेलीविजन अधिनियम आदि जैसे विभिन्न डोमेन में किया जाता है।

भारत में सेंसरशिप कैसे कार्य करती है?

• इस धारा के तहत यदि किसी समाचार पत्र, पुस्तक या दस्तावेज या जहाँ भी यह मुद्रित होते हैं, में कोई ऐसा मामला है जिसे राज्य सरकार, राज्य के लिये हानिकारक मानती है तो वह एक आधिकारिक अधिसूचना के माध्यम से राज्य सरकार द्वारा दंडनीय होगा।
• इसके तहत मजिस्ट्रेट 'आपत्तिजनक' प्रकाशनों की तलाशी के लिये वारंट जारी करने की अनुमति दे सकता है।
• केंद्रीय फिल्म प्रमाणन ब्यूरो (CBFC) सिनेमैटोग्राफी अधिनियम, 1952 के तहत संचालित एक वैधानिक निकाय है।
• यह सार्वजनिक डोमेन में लाई जाने वाली फिल्मों की सामग्री को नियंत्रित करता है।
• CBFC फिल्मों के पूर्व प्रमाणन की प्रणाली का पालन करता है। प्रसारक प्रदत्त प्रमाणन का पालन करने के लिये 'कार्यक्रम संहिता और विज्ञापन संहिता' के तहत दिशानिर्देशों से बंधे होते हैं।
• अप्रतिबंधित सार्वजनिक प्रदर्शनी (U)।
• अप्रतिबंधित सार्वजनिक प्रदर्शनी लेकिन सावधानी के साथ 12 वर्ष से कम उम्र के बच्चों के लिये माता-पिता के विवेक की आवश्यकता (U/A)।
• अवयस्कों के लिये प्रतिबंधित (A)।
• व्यक्तियों के किसी विशेष वर्ग के लिये प्रतिबंधित (S)।
• यह एक वैधानिक और अर्ध-न्यायिक निकाय है जिसे प्रेस परिषद अधिनियम, 1978 के तहत स्थापित किया गया था।
• यह प्रेस के लिये स्व-नियामक निकाय के रूप में कार्य करता है और मीडिया डोमेन में आने वाली चीज़ों को नियंत्रित करता है।
• यह निकाय मीडियाकर्मियों और पत्रकारों द्वारा आत्म-विनियमन की आवश्यकता पर ज़ोर देता है, और बड़े पैमाने पर मीडिया सामग्री के लिये एक प्रहरी के रूप में कार्य करता है ताकि यह आकलन किया जा सके कि क्या यह प्रेस नैतिकता और सार्वजनिक हित के खिलाफ है।
• यह अधिनियम वैसी सामग्री को भी फिल्टर करता है जिसे प्रसारित किया जा सकता है।
• केबल ऑपरेटरों पर नजर रखने के लिये अधिनियम केबल ऑपरेटरों के लिये पंजीकरण अनिवार्य करता है।
• यह केबल ऑपरेटर द्वारा प्रसारित की जाने वाली सामग्री को विनियमित करने के लिये प्रावधान भी करता है। केबल टेलीविजन के माध्यम से प्रसारण के पूर्व यह CBFC द्वारा श्रेणी- U (यानी अप्रतिबंधित सार्वजनिक प्रदर्शनी) के तहत फिल्म के प्रमाणन को अनिवार्य करता है, भले ही फिल्म भारत में निर्मित हो या विदेश में।
• यह अधिनियम सरकार को केबल ऑपरेटरों, चैनलों या कुछ कार्यक्रमों पर प्रतिबंध लगाने के लिये पर्याप्त शक्ति प्रदान करता है जो 'केबल टेलीविजन नेटवर्क नियम’ अधिनियम के तहत बनाए गए नियमों द्वारा निर्धारित कार्यक्रम कोड या दिशानिर्देशों का उल्लंघन करते हैं।
• सोशल मीडिया की वृद्धि दर को देखते हुए, इसकी सेंसरशिप भारत में चिंता का विषय रहा है क्योंकि हाल के दिनों तक, यह किसी भी सरकारी प्राधिकरण और विशिष्ट विनियमन की प्रत्यक्ष देखरेख में नहीं था।
• वर्तमान में, सूचना और प्रौद्योगिकी अधिनियम, 2000 सोशल मीडिया के उपयोग को विनियमित करता है एवं विशेष रूप से धारा 67A, 67B, 67C और 69A में विशिष्ट नियामक खंड शामिल हैं।
• इन्हें IT अधिनियम, 2000 के तहत 'एलोकेशन ऑफ बिजनेस रूल्स' में संशोधन कर लाया गया था, ताकि फिल्मों, ऑडियो-विजुअल कार्यक्रमों, समाचार, समसामयिक मामलों की सामग्री और अमेज़ॅन, नेटफ्लिक्स और हॉटस्टार जैसे OTT (ओवर द टॉप) प्लेटफार्मों सहित डिजिटल और ऑनलाइन मीडिया को सूचना और प्रसारण मंत्रालय, भारत सरकार के दायरे में लाया जा सके।
• इस संशोधन के बाद लागू IT (मध्यवर्ती दिशानिर्देश और डिजिटल मीडिया आचार संहिता) नियम, 2021 में सोशल मीडिया, OTT, डिजिटल समाचार और यहाँ तक कि मैसेजिंग ऐप (जैसे व्हाट्सएप और वाइबर) के लिये नए अनुपालन और निवारण तंत्र शामिल हैं।

सेंसरशिप के पक्ष और विपक्ष में तर्क:

• सेंसरशिप आपत्तिजनक सामग्री के प्रकटीकरण की रोकथाम करके समाज में वैमनस्य को रोकता है जो सांप्रदायिक कलह का कारण बन सकता है
• इंटरनेट की सेंसरशिप सामाजिक स्थिरता और राष्ट्रीय सुरक्षा की रक्षा करने में मदद कर सकती है।
• चूंँकि इंटरनेट सेंसरशिप बड़ी संख्या में अवैध गतिविधियों और इंटरनेट अपराधों को रोकने में मदद कर सकती है, इसलिये यह समाज की स्थिरता के लिये अच्छा है।

• सेंसरशिप समाज में नैतिकता बनाए रखने में मदद कर सकती है।
• सरकार झूठी मान्यताओं या अफवाहों के प्रसार को रोकने के लिये सेंसरशिप का उपयोग कर सकती है और साथ ही उनके सार्वजनिक प्रदर्शन पर रोक लगाकर अन्य लोगों की हानिकारक गतिविधियों तक पहुँच को प्रतबंधित कर सकती है।
• इंटरनेट की सेंसरशिप अनुचित जानकारी को ऑनलाइन फ़िल्टर कर सकती है और बच्चों को परेशान करने वाली वेबसाइटों यथा बाल पोर्नोग्राफी, यौन हिंसा और अपराध या नशीली दवाओं के उपयोग में विस्तृत निर्देश से बचा सकती है।
• सेंसरशिप कानून का व्यावहारिक अनुप्रयोग नैतिक पुलिसिंग का एक उपकरण बन सकता है जो बड़े सार्वजनिक मुद्दों के साथ खुद को संबंधित करने के बजाय अन्य लोगों के जीवन को नियंत्रित करता है।
• नए नियमों के तहत नियामक निकाय को दी गई व्यापक शक्तियांँ, जो नौकरशाहों के अधीन हैं, विवेकाधीन राजनीतिक नियंत्रण का जोखिम भी उठाती हैं।
• नैतिकता, रूचि और अरुचि की परिधि में भारत में व्यापक भिन्नता है।

• एक खुले समाज में, सूचना नियंत्रण की कोई भी प्रणाली स्व-विनियमन की डिग्री पर निर्भर करेगी, भले ही राज्य द्वारा उसकी देखरेख की जाए। अतएव इस हेतु अन्य विकल्प अव्यावहारिक और वैचारिक रूप से अस्वीकार्य हैं।
• अधिसूचना और प्रलेखन के संदर्भ में इन मामलों का संचालन सक्रिय होनी चाहिए।
