American Burger King gets interim relief in trademark infringement suit against Pune’s Burger King

The Bombay High Court on Monday granted an interim relief to the American fast food giant Burger King Corporation in a trademark infringement lawsuit filed by the company against a Pune-based burger joint carrying the same brand name, ‘Burger King’. The High Court issued the interim stay on July 16, 2014, order that was passed by a Pune district judge Sunil Gangadharrao Vedpathak in favour of the Pune-based food restaurant.

A Division Bench of Justices A.S. Chandurkar and Rajesh Patil on Monday said the ad-interim stay order will operate till the next date of hearing of the case scheduled for September 6. The High Court said it will first hear the Burger King’s stay application.

Granting interim relief to the American food joint, the High Court said: “If you do not agree to the appeal, we can give a date. Meanwhile, the ad interim relief may continue [in favor of the appellant-Burger King Corporation].”

The interim application by the American Burger King said, “Trademark law is intended to protect consumers and ensure that there is no likelihood of confusion in the market. Trademarks are source identifiers and function as a badge of origin. They inform the customers that the services provided thereunder originate from a particular undertaking and allow consumers to make informed decisions. In the present case, the public in India as well as the world at large exclusively associate the trade mark BURGER KING with the Appellant’s restaurants. The Appellant’s BURGER KING trade mark has been declared as a well-known trademark in India by the Delhi High Court.”

The Burger King Corporation has sought a permanent injunction from the High Court to restrain Pune’s Burger King restaurant from using the trademark ‘Burger King’.

Appearing for the Burger King Corporation, advocates Avesh Kayser and Hiren Kamod, in the application, contended that the name of the burger joints [Burger King Corporation and Pune-based Burger King] provide home delivery services including through established third-party platforms such as Zomato and Swiggy.

”Users on these platforms will not be able to differentiate between the services of both parties if they are both offer these under an identical trademark. This is just one example of the inevitability of consumer confusion and significant prejudice resulting from the impugned judgment and the cessation of the operation of the injunction restraining the respondents from using the appellant’s registered and well-known trademark.”

Appearing for the Pune-based food joint, Burger King, registered under the owners Anahita Irani and Shapoor Irani with businesses in Pune’s Camp Cantonment and Koregaon Park, advocate Abhijit Sarwate argued: “The eatery owned by Anahita Irani and Shapoor Irani is famous in Pune since the 1990s. In fact, the plaintiff company is usurping our goodwill in Pune. Why is a giant company like the plaintiff (Burger King Corporation) fearing us?”

Advocate Sarwate informed the court that the Pune-based food joint started using the trademark name ‘Burger King’ pursuant to the July 16 decision by the trial court in Pune.

Judge Vedpathak, in his ruling, had said that the Pune-based Burger King has been operating in the market for a long time with the same brand name without any objection.

”With respect to relief of perpetual injunction is concerned, admittedly the plaintiff has started to provide services through restaurant under its trademark Burger King in India particularly in the year 2014 whereas since 1991-92 defendants are using the trademark Burger King to provide restaurant services. Even the plaintiff has not placed on record the registration certificate about registration of its trademark in India under class 42 prior to 1991-92,” the judge said.

“Admittedly, the plaintiff has registered its trademark Burger King under class 42 pertaining to restaurant services is of 06.10.2006. So, considering the fact that defendants are prior user of trademark in question, I am of the opinion that the plaintiff has no cause of action to seek relief of perpetual injunction,” the judge further said.
