Biden Administration Pauses Student Loan Payments Amid Legal Challenges

Eight million borrowers enrolled in the repayment plan known as SAVE will be placed in an interest-free forbearance while the administration deals with legal issues.

The Biden administration is pausing student loan payments for eight million borrowers enrolled in its new repayment plan, known as SAVE, after a federal appellate court issued a ruling temporarily blocking the program.

“Borrowers enrolled in the SAVE plan will be placed in an interest-free forbearance while our administration continues to vigorously defend the SAVE plan in court,” Miguel Cardona, the secretary of education, said in a statement. “The Department will be providing regular updates to borrowers affected by these rulings in the coming days.”

For now, borrowers are unable to apply to the SAVE repayment plan, and applications for other income-driven repayment plans are also unavailable.

The U.S. Court of Appeals for the Eight Circuit, based in St. Louis, granted a request by Missouri and other Republican-led states for an administrative stay, which prevents the Biden administration from “implementing or acting pursuant” to the rule that created the SAVE program last summer, according to the court filing.

The SAVE program , which ties monthly payments to a borrower’s income and household size, is more generous than previous iterations of income-driven repayment plans and has generated zero-dollar payments for 4.5 million low-income borrowers.

The one-page order, issued on Thursday, is just the latest in a series that have sprung from separate lawsuits brought by two groups of Republican-led states challenging the legality of the SAVE repayment plan, throwing millions of borrowers — and their financial lives — into limbo.

Federal appeals court blocks all of Biden’s student debt relief plan

The St. Louis-based 8th U.S. Circuit Court of Appeals granted a request by seven Republican-led states to put on hold parts of the U.S. Department of Education’s debt relief plan that had not already been blocked by a lower-court judge.

A federal appeals court on Thursday blocked President Joe Biden’s administration from continuing to implement a new student debt relief plan designed to lower monthly payments for millions of Americans .

That ruling last month by U.S. District Judge John Ross in St. Louis had blocked the department from granting further loan forgiveness under the administration’s Saving on a Valuable Education (SAVE) Plan but had not blocked all of the plan.

That plan provides more generous terms than past income-based repayment plans, lowering monthly payments for eligible borrowers and allowing those whose original principal balances were $12,000 or less to have their debt forgiven after 10 years.

State attorneys general led by Missouri Attorney General Andrew Bailey subsequently last week asked the 8th Circuit to block the rest of the SAVE Plan. The court did so through a one-page order granting an administrative stay.

Bailey on the social platform X hailed the ruling as a “huge win for every American who still believes in paying their own way.” He said the student loan plan “would have saddled working Americans with half-a-trillion dollars in Ivy League debt.”

The Education Department had no immediate comment.

Biden, a Democrat, announced the SAVE Plan in 2022, alongside a broader $430 billion program that would have fulfilled a campaign promise by cancelling up to $20,000 in debt for up to 43 million Americans. It was ultimately blocked by the conservative-majority U.S. Supreme Court in June 2023.

The SAVE Plan was slated to fully take effect on July 1, though parts of it have already been implemented.

The White House has said that over 20 million borrowers could benefit from the SAVE Plan. The administration in May said that 8 million are already enrolled, including 4.6 million whose monthly payments have been reduced to $0.

The Education Department on Thursday said it had already granted $5.5 billion to 414,000 borrowers through the SAVE Plan.

Another federal judge in Kansas had also blocked parts of the SAVE Plan last month , though a different federal appeals court, the Denver-based 10th U.S. Circuit Court of Appeals, put part of that decision on hold. A group of Republican-led states have asked the U.S. Supreme Court to reinstate that injunction.

The San Diego County Office of Education is recruiting for a Communication Strategist for the Communications department of the Administrative Services division. The Communications Strategist is responsible for providing timely and accurate information to employees, districts, communities, and other educational partners; supporting SDCOE leadership and staff with communications-related issues, including crisis communications and community relations; and creating a variety of materials and tools to facilitate effective and uniform communications of SDCOE initiatives, priorities, and positions to a variety of audiences. ABOUT COMMUNICATIONS The San Diego County Office of Education (SDCOE) works regularly with school and media personnel to help get the word out about what’s happening in schools throughout the county. Our teammates have contacts in local print, television, and radio news departments, and can help educators with strategies for working with the media. Internally, SDCOE produces a variety of publications and documents to keep the more than 1,000 people working for the County Office of Education informed. Another important aspect of SDCOE communications is to facilitate partnerships between schools and businesses. These include internships for students and teachers, sponsorships of school programs, student and staff recognition programs, scholarships, and academic incentive programs. SDCOE recognition programs include the annual Salute to Teachers event, as well as efforts that shine a spotlight on deserving educators and classified school employees throughout the county. SDCOE also celebrates the efforts of students, like those who compete at the annual San Diego County Spelling Bee. Requirements / Qualifications

This position requires a combination of education and experience equivalent to a bachelor’s degree with a major in public relations, journalism, communications, advertising, graphics, or a closely related field, and three (3) years of experience in the development, design, and implementation of communications/public relations strategies and related media, including online and print materials. Certificates and Licenses: • Valid California Driver’s License
