While commentating upon the ‘law as a system of rules’, Salmond took ‘contract bridge’ as an example . At that time, Salmond would not have imagined that the rules of game would take such a proportion that it would necessitate a separate branch of study called ‘sports law’. Well, now sports law has a definite position in legal system and new sports law jurisprudence – lex sportiva is emerging. Increasing interaction between the sports and law has led to the development of sports law. Sports touches varied areas of law and the legal principles are adapted to the situation in sports. Areas of law like contract, tax, competition, discrimination share a boundary with sports when issues arises relating to performance of a contract or selection of a player on the basis of racial discrimination. There are larger issues of match-fixing, doping, and violence too. However, there is a haphazard development of sports law, reason being most of the rules being governed by various organization and as Salmond said ‘a person is subject to the rules of the game only when he plays the game.’ There are other areas like advertising rights, restraint clauses for players in contracts. The problem gets still larger when it comes to international sports where we already are under the porous roof of international law. The present article traces the development of sports law and points out key issues in sports law. The paper has five parts. First part deals with the introduction of sports law which includes the development of ‘sports law’ from ‘sports and law’; difference between amateur and professional sports, international sports law and global sports law. The second and third part discusses about the international sports federations and international sports organizations respectively. Fourth part discusses various issues involved in sports law and the paper ends with discussion on status of sports law in India.

In the twenty-first century, domestic politics has played a key role in determining the behavioural attributes of Board of Control for Cricket in India (BCCI). Hence, it emerged as an intermediary entity for promoting the national interest of the government. Besides, the growing commercialization of Indian cricket have paved the way for BCCI to emerge as a financial powerhouse at the turn of the new millennium. Against this backdrop, the article attempts to figure out if BCCI reveal the larger dynamics of the Indian government, politics and economy in a tacit manner. Put differently, the governance of cricket by the BCCI is subject to regulation by the administrative and judicial apparatus of the Indian state. The article strives to link cricket with crucial aspects of national security, diplomacy and Indian business through its discussion of India-Pakistan cricket series, the negotiations in the International Cricket Council (ICC) and Indian Premier League (IPL).

Apart from the rich culture and diverse arts presence, India has tremendous experience in different sporting activities such as athletics, cricket, shooting, hockey, chess, badminton, boxing, golf, kabaddi, wrestling, swimming etc. Besides this the country has respectable traditional sports such as boat racing, Most of the games are controlled and managed by the federation under the leadership of Indian Olympic association. Sport’s is one arena where India lags behind other countries

Journal of Asian and African Studies, Vol. 48, No. 5 (2013)

In the past decade India has become the financing hub for cricket, a broadcaster in its own right, and an agenda-setter in the management of all forms of the game. What some commentators have called the ‘Indianization’ of cricket extends beyond business: it is a social, political, and cultural phenomenon. For five seasons, the Indian Premier League (IPL) has offered a glimpse of this phenomenon, prompting enthusiasm from young fans and those who stand to profit from the new league, and resistance from traditionalists. This paper discusses the material and symbolic roles the IPL has come to play in global cricket. It begins with an overview of the IPL’s history, discusses how the IPL is changing the global business of cricket, and explores how the IPL is challenging the traditional culture of the sport. The paper concludes with arguments about the IPL as a grand spectacle, and a cultural phenomenon that, despite its problems, might prove its critics wrong. Throughout, the paper treats the IPL as a useful case study not only in the business of sports, but also more widely in our theoretical and empirical studies of globalization.

The idea of speed has become central to much of modern sport. Contemporary cricket in India is no exception to this trend. In the shift from test matches to one-day and then to Twenty20 formats, however, there has been a profound reworking of the internal biology of the game itself. Cricket is no longer played out primarily for ‘spectators’. Rather, the speeding up of the game has become contingent on redesigning cricket into a ‘platform’; which is now animated by combining hitherto unrelated elements such as businesses, advertising, technology, and even Bollywood. In particular, the Indian Premier League (IPL) has made profound transformations in which the traditional building blocks of players, administrators, and coaches have been sutured, in varying combinations, with politicians, businesses, film stars, physiotherapists, nutritionists, software engineers, statisticians, specialised coaches, videographers, and public relations managers. The game, hence, both on and off the field, comprises multiple and often disjointed foci. In this de-centred sporting universe, however, several fragilities and instabilities have begun to set in: match fixing, betting, corruption, technological complexity, political control, and even the systematic blurring between sport and entertainment.

As we know Sports Law in India is one of the very niche and developing phase as compared towards worldwide. We know that sports formed an important part of ancient India when the Kings and Queens played various sports as a means of fun as well as a mode of leisure for the population. Also sports were once a means of revenue for the players and did not flourish as a profession or an entertainment. You cannot believe that legislation governing these sports or federations has been established in support of athletes and their skills, but we do know that they have entered into contracts only to make money for themselves and amuse the Kings and their people. The star games were royal games and aristocracy, games like Chess, Archery, Hockey, Polo, and Wrestling. Any of them have been adopted as families' rituals. When people's values and thinking evolved, the view of sport often shifted and became an experience full of passion, encouragement and the urge to demonstrate before the rest of the country. Events all over the world began gradually in India, and the State provides support for the development of players' training centres. Even after this move, since government and citizens lacked inspiration and the lack of standardised regulations for sport, India was not able to represent its talents properly. Also in modern times, there is no significant legislation to govern the Sports Law in India, as one proper national legislation. So this handbook will help us to understand what are place we are lacking and what are the challenges which can come to develop the Sports Law in India, as one book.

This study seeks to find an answer to this question: which one can be a successful model in sports in India: Planned Approach or a Spontaneous Order?’ The study explains that planned sporting activities in India have not led to any significant achievements for the country in competitive sporting events. In other words, government spending on sports has failed to generate substantial returns in terms of producing competitive athletes or good sports facilities to promote them. Executive Summary Freedom and financial independence from the state are decisive in improving sports in India. The federal government is a facilitator of sports development in the country. However, it has been observed that in recent times cronyism is a constant phenomenon in sports associations/councils. In the most glaring case, India was banned from....
